Talaq given to christian wife with understanding of cancellation if we touch or are intermate with niyat of reconciliation within time frame
Dear ulama
I am in nikkah to a christian lady. I have given talaq with sincere understanding if we touch or are intermate with niyaat of reconciliation the talaq will be cancelled n fall away.
I have given 3 talaqs with this understanding.
Is our nikkah valid?
If not, Is there an option to make the nikkah valid?

Wa’alaykum as Salam wa rahmatullahi wa barakatuhu,
When a person clearly mentions the words of divorce, his intention no more holds any merit. The Nikah will break, irrespective of what intention or in what context he uttered those words.
Mentioning emphatic words of divorce constitutes a Talaaq-Mughalladhah (an irrevocable divorce). A Talaaq-Mughalladhah demands immediate separation between the spouses. Reconciliation can only take place after Halalah with a renewed nikah.
Halalah is the process where the wife passes her iddah (waiting period) and marries another man and consummate the marriage. If the second husband divorces her or passes away, she should observe the ‘Iddah of this second marriage. Thereafter, she would be at liberty to return to her first husband.

وبلغنا عن رسول الله – صلى الله عليه وسلم – أنه إذا طلق الرجل امرأته ثلاثاً فتزوجت زوجاً غيره أنها لا تحل للأول حتى يدخل بها الثاني ثم يطلقها (الأصل للشيباني – 4/ 392)
